  • Construction projects often suffer delays. Whether caused by the Client such as through design changes, by the Contractor from delays in their supply chain or outside of the control of either party such as weather and pandemics.

    Entitlement to an Extension of Time will depend on assessing which event has effected progress of the works and ultimately the completion date, this process is commonly referred to as delay analysis.

    There are varying forms of analysis and so Consilium Construction Experts work with clients to identify available records and data which determine the appropriate form of analysis. This enables us to provide clients with swift high-level assessments of their potential risk and likely costs prior to undertaking more detailed analysis.

  • Quantum claims may involve the loss incurred due to delays such as prolongation costs, assessment of unliquidated delay damages or valuation of disruption to a project in terms of productivity or additional costs. Quantum assessments may also entail the review of complex variations and final accounts that have become the focus of a dispute.

    It is common for construction projects not to be delivered for the original value in the contract. Where the value for the project is in dispute between the Parties, this is where an Expert report can provide independent assessment of the position for use in settlement negotiations or dispute resolution. Consilium Construction Experts provides expert quantum advice and reports for wide ranging quantum matters and can be appointed solely for quantum matters or linked to the appointment for delay so that role is combined.

  • Consilium Construction Experts works with clients and their supporting consultant and legal teams through the dispute process. This may include the provision of expert witness reports compliant with litigation and arbitration procedures, expert reports for adjudication or a joint party appointed expert to assess a matter. Each of these forms of dispute resolution first start with negotiations and a strategy on how to proceed and Consilium Construction Experts can be actively engaged in assisting our client’s team at stage of this process enabling the client team to make decisions on strategy towards a successful resolution.

  • Standard form contracts are common place, equally common are bespoke amendments and particular conditions altering risk. We work with our clients and their solicitors to assess the impact and associated risk of such amendments or changes to achieve a realignment of risk that is acceptable.

    We also provide clients with ongoing support on contractual interpretation and administration of the construction contract assist in the drafting of notices and correspondence.
